What is the Charter of Patients’ Rights?
Charter of Patients Rights – Union Ministry of Health and Family Welfare ने National Human Rights Commission के द्वारा बनाये गए ड्राफ्ट Charter of Patients Rights को जारी किया था। राज्य सरकार के जरिए यूनियन मिनिस्ट्री ऑफ़ हेल्थ इस चार्ट को हर एक राज्य में शुरू करेगी। इस चार्ट की मदद से राज्य और केंद्र के मरीजों के अधिकारों की सुरक्षा के लिए सही Mechanism स्थापित करने में मदद मिलेगी। Union Ministry Of Health and Family Welfare ने Charter of Patients Rights को अपनी वेबसाइट पर जारी किया था।
What Are the Importance of Charter of Patients Rights ?
भारत में Patient के अधिकार के नियम हर राज्य में अलग – अलग हैं। कुछ राज्यों ने खुद के नियम बना रखे हैं और कुछ राज्यों ने ही National Clinical Establishment 2010 को स्वीकार किया है। सेहत क्षेत्र में बिना किसी भेदभाव के इलाज होना बहुत ही जरूरी है। Patient के साथ किसी बीमारी और Health Status जैसे HIV Status, जाति, धर्म के आधार पर पक्षपात नहीं किया जाना चाहिए।

What Are The Legal Documents on Patients Rights ?
भारत में Patients के अधिकार से संबंधित विभिन्न क़ानूनी प्रावधान है जो विभिन्न क़ानूनी दस्तावेजों में बिखरे हुए हैं :
- The Constitution of India, Article 21
- Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations 2002
- The Consumer Protection act 1986
- Drugs and Cosmetics act, 1940
- Clinical Establishment act 2010
Charter of Patients Rights ?
1 . Rights To Information :
Patient को Nature, बीमारी का कारण, Provisional / Confirmed Diagonosis, प्रस्तावित जांच और प्रबंधन और अगर कोई Possible Complications हैं तो उनके के बारे में Adequate और Relevant Information उनकी भाषा में प्रदान करनी चाहिए। जिस भाषा में वे समझ सके।
Patient और उनके Caretaker को भी विभिन्न देखभाल प्रदाताओं की Professional Status के बारे में जानने का अधिकार है।
2 . Rights To Records & Reports :
हर एक Patient या उनके Caretaker को Case Paper, Indoor Patients Records, Investigation Reports की कॉपी प्राप्त करने का पूरा अधिकार है।
Appropriate Fees की Payment करने के बाद फोटोकॉपी उपलब्ध कराया जाना चाहिए या रोगियों द्वारा उनकी लगत पर फोटोकॉपी करने की अनुमति दी जानी चाहिए।
3 . Right to Emergency Medical Care :
Supreme Court के अनुसार सारे सरकारी या प्राइवेट हस्पतालों की ये ड्यूटी बनती है की Patient को Emergency Medical Care प्रदान की जाये और Injured Patient को Emergency Medical Care प्राप्त करने का अधिकार है।
इस तरह की देखभाल बिना पेमेंट / एडवांस की मांग किये बिना शुरू की जानी चाहिए और Patient को Payment Capacity की परवाह न करते हुए बेसिक केयर प्रदान करनी चाहिए।
4 . Right to Informed Consent :
Patient के पास अधिकार होता है की वो कोई भी Investigation / Surgery को लेकर अपना Consent दे सकते हैं जिसमे कोई रिस्क हो, डॉक्टर तभी आगे बढ़ सकते हैं जब तक Patient या Caretaker Written में अपना Consent नहीं दे देते।
5 . Right to Confidentiality, Human Dignity and Privacy :
Charter of Patients Rights के अनुसार हर एक Patient के Privacy का अधिकार है, और डॉक्टर की ड्यूटी है की वो अपनी Health Conditions और Treatment Plans के बारे में सख्त गोपनीयता में जानकारी रखें, जब तक की Specific Circumstances में या दूसरे की सुरक्षा के हित में ऐसी Information को संप्रेषित करना जरूरी न हो।
महिला Patient को एक Male Practitioners के द्वारा Phyiscal Examination किये जाने के दौरान अन्य महिला की उपस्थिति का अधिकार है।

6 . Right to Second Opinion :
Patient को अपनी या Caretaker की मर्जी के मुताबिक Second Opinion यानि के किसी Appropriate Clinic से सलाह लेने का अधिकार है। Hospital को Patient के Second Opinion के राइट का समर्थन करना चाहिए और सारे जरूरी Records और जानकारी प्रदान करनी होगी बिना किसी Cost या Delay के।
इस दौरान अगर कोई Discrimination Practice हो जाती है तो उसे “Human Right Violation” कहा जाएगा।
7 . Rights To Transparency in Rates and Care as Per Prescribe Rates :
हर Patient और उनके Caretaker को Information प्राप्त करने का हक़ है। जिसमे Hospital के द्वारा Service और Facility के क्या Charges या Rates है वो Brochure और बोर्ड पर Available रखेंगे। तो इसके अनुसार Payment के दौरान व्यक्ति को एक Detailed Bill प्राप्त करने का अधिकार है।
8 . Right To Non-discrimination :
हर Patient को बिना किसी भेदभाव के इलाज करवाने का हक़ है। भेदभाव जैसे की Patient की बीमारी या HIV Status, Health Condition, धर्म, जाति, लिंग, Sexual Orientation, भाषा के आधार पर आदि।
9 . Right to Safety and Quality Care According To Standards :
Patient को Hospital में जहा ट्रीटमेंट दिया जा रहा है वो जगह साफ होनी चाहिए, जहाँ Infection Control Measures फॉलो हो, जहा पिने का पानी साफ़ होना चाहिए और जहा Standars और Sanitation Facilities Available हो।
10 . Rights to Choose Alternative Treatment Options if Available :
Charter of Patients Rights के अनुसार Patients और Caretaker को स्थिति के सभी पहलुओं पर विचार करने के बाद Alternative Treatment और Management Options के बीच चयन करने का अधिकार है, यदि उपलब्ध है तो।
11 . Right to Choose Source for Obtaining Medicines or Tests :
Doctor या Hospital के द्वारा जो Medicine बताई जाएगी तो Patient और Caretaker अपनी मर्जी से कोई भी Registered Pharmacy से वो दवाई खरीद सकते हैं।
जब Hospital या Doctor कोई Particular Investigation Advise करते हैं तो Patients अपने हक़ के अनुसार कोई भी Diagonstic Centre / Laboratory को चुन कर अपनी Investigation वहां से पूरी कर सकते हैं।

12 . Right to Proper Refferal and Transfer, Which is Free From Perverse Commercial Influences :
Patient को निरंतरता देखभाल का अधिकार है, और पहली हैल्थकेयर फैसिलिटी में जहा इलाज चल रहा है, साथ ही साथ किसी भी बाद की सुविधा जहा देखभाल की मांग की जाती है, में Registered करने का अधिकार है।

13 . Right To Protection For Patients Involved in Clinical Trials :
Clinical Trail में भाग लेने वाले के लिए संपर्क किए जाने वाले रोगियों को उचित सुरक्षा का अधिकार है।
सारे Clinical Trail Central Drugs Standards Control Organisation और अन्य Applicable Provisions द्वारा जारी Protocols और अच्छे Clinical Practice के अनुपालन में आयोजित किया जाना चाहिए।
14 . Right to Protection of Participants Involved in Biomedical and Health Research :
Charter of Patients Rights के अनुसार Patient जो Biomedical Research में भाग ले रहा है उसे एक Research Participant के रूप संदर्भित किया जायेगा और हर Research Participant को उचित सुरक्षा का अधिकार है।
ऐसे Participants को शामिल करने वाली Research को Human Participants को शामिल करते हुए Biometric और Health Research के लिए Nationla Ethical Guideline का पालन करना चाहिए।
15 . Right to Take Discharge of Patients, or Receive Body of Deceased From Hospital :
Patient को अस्पताल से छुट्टी लेने का अधिकार है और अस्पताल शुक्ल के भुगतान के विवाद में जैसे प्रक्रियात्मक आधार पर अस्पताल में हिरासत में नहीं लिया जा सकता।
इसी तरह Caretaker करने वाले को इलाज करवा रहे मरीज के Body पर पुरा अधिकार है और Caretaker की मर्जी के खिलाफ अस्पताल शुल्क के भुगतान के संबंध में पेमेंट न करने / विवाद सहित प्रक्रियात्मक आधार पर विस्तृत नहीं किया जा सकता।
16 . Right to Patient Education :
Patient को उनकी बीमारी और Healthy Living Practices, उनके Rights और Responsibilities, Health Insurance योजनाओं से संबंधित प्रमुख Facts के बारे में Education प्राप्त करने का अधिकार है। Charitable Hospital के मामले में प्रासंगिक अधिकार और रोगी समस्या का निवारण कैसे प्राप्त करें इसके बारे में उन्हें जानकारी प्रदान करनी चाहिए।
17 . Rights to be Heard and Seek Redressal :
Charter of Patients Rights के अनुसार Patient और Caretaker को डॉक्टर या अस्पताल से प्राप्त Health Care के बारे में अपने विचार देने, कमेंट करने या कोई भी शिकायत होने पर शिकायत दर्ज करने का अधिकार है।
Patient’s Responsibilities
- डॉक्टर को स्वास्थ्य के बारे में सारी जानकारी प्रदान करें।
- Treatment और Examination के दौरानडॉक्टर का सहयोग करें।
- सारे Instructions को फॉलो करें।
- अस्पताल के लिए तय समय पर फीस का भुगतान करें।
- किसी भी हिंसा का सहारा न लें।
- डॉक्टर और अस्पताल के अन्य कर्मचारियों की गरिमा का सम्मान करें।
